Terms of Service
Effective Date: September 8, 2026
1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you (“Client” or “Homeowner”) and Red Rose Landscaping (“Company,” “we,” or “us”). By accessing our website, submitting an inquiry, or engaging our residential landscaping services, you agree to comply with and be bound by these terms.
2. Scope of Residential Landscaping Services
Red Rose Landscaping provides residential landscaping, landscape design, flower bed makeovers, privacy shrub installation, pavers and walkways, Brazos rock landscaping, and exterior curb-appeal improvements. Every project scope, deliverables, and associated costs are defined in an individualized written quote or project agreement agreed upon prior to project commencement.
3. Estimates, Quotes & Work Authorization
Quotes provided through website submissions or verbal consultations are estimates based on initial homeowner descriptions. Final quotes are confirmed following an on-site property walkthrough. Work begins only after the homeowner approves the agreed project scope and terms.
4. Payment Terms & Stripe Compliance
Payment obligations, deposit requirements, and progress payment schedules (if applicable) are outlined on each project estimate or invoice.
- Accepted electronic payment methods include major credit/debit cards processed securely via Stripe, ACH bank transfers, or approved company invoicing methods.
- Invoices are due upon receipt or according to the explicit due date stated on the invoice.
- Card transactions are encrypted end-to-end via PCI-compliant payment infrastructure. Red Rose Landscaping never retains unencrypted card numbers or security codes.
5. Homeowner Responsibilities
To ensure a safe and smooth project execution, the homeowner agrees to:
- Provide unobstructed access to the work area (gates unlocked, vehicles moved, pets secured).
- Identify and disclose private underground features (such as invisible dog fences, low-voltage lighting, or private drainage lines) prior to excavation or planting.
- Provide reasonable access to an outdoor water source when required for plant establishment.
6. Weather & Scheduling Adjustments
Outdoor landscaping work in Texas is subject to weather conditions (heavy rain, severe heat, saturated soil, freeze events). While we prioritize dependable follow-through, schedules may be adjusted to protect soil integrity, plant health, and worker safety. We will communicate schedule updates promptly.
7. Limitation of Liability & Governing Law
To the fullest extent permitted by Texas law, Red Rose Landscaping shall not be liable for incidental, indirect, or consequential damages arising from site access delays or unforeseen underground conditions. These terms are governed by the laws of the State of Texas, with venue in Rockwall County, TX.
